Terms of Service

These Terms of Service ("Terms") govern your use of the Word Smash mobile app, website, and related services (together, the "Service"), provided by Small Big Brands LLC ("we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or 16 if you are in the European Union, to use the Service. By using the Service, you confirm that you meet this requirement.

2. Accounts

Some features may work without an account. If you sign in with Apple or Google, you are responsible for keeping that account secure. We may treat activity through your signed-in account as authorized by you.

3. What Word Smash provides

Word Smash provides vocabulary games, review scheduling, progress tracking, and related learning features. The Service is a learning tool. It does not guarantee any particular educational result.

4. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, abusive, or fraudulent activity.
• Interfere with or disrupt the Service or its infrastructure.
• Reverse engineer, scrape, probe, or attempt to extract the Service except as allowed by law.
• Use automated tools to access the Service without our written permission.
• Violate third-party rights, including intellectual property and privacy rights.

5. Purchases and subscriptions

If Word Smash offers paid features, payments are processed by Apple's App Store or Google Play. Their payment terms, cancellation procedures, renewal rules, and refund policies apply. We may change paid features or pricing with notice where required by law.

6. Your content and feedback

You keep ownership of content you provide to the Service, such as support messages or feedback. You grant us a limited license to host, process, display, and use that content only as needed to operate, support, and improve the Service. If you send ideas or feedback, you allow us to use them without restriction or compensation.

7. Intellectual property

The Service, including its software, design, artwork, text, logos, gameplay systems, and other materials, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you ownership of the Service.

8. Service availability

We try to keep the Service available, but outages, maintenance, bugs, device compatibility issues, and third-party service failures may occur. We may change, suspend, or discontinue features at any time.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if we believe you violated these Terms, created risk for the Service or other users, or used the Service unlawfully.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your learning goals.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim related to the Service or these Terms will not exceed the greater of 100 USD or the amount you paid us in the 12 months before the claim. We will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or business opportunities.

12. Indemnification

You agree to indemnify and hold Small Big Brands LLC harmless from claims, damages, losses, liabilities, and expenses arising from your misuse of the Service or violation of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will update the date above and provide additional notice where appropriate. Continued use after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in Delaware, unless applicable law requires a different forum.
